Notice of Change to waiver procedure
On July 8th, 2025 the Snohomish County Board of Health adopted Ordinance BOH25-06 relating to variances and waivers.
Under Washington Administrative Code (WAC) 246-272A-0210, the health officer may allow reduced horizontal separations for on-site sewage systems (OSS) in certain cases. For example, reducing the setback between surface water and an OSS to 75 feet. Previously, these proposals required a waiver application.
To align with Ordinance BOH25-06 and to ensure consistency with state and local regulations, proposals to reduce horizontal separations that are fully addressed in WAC 246-272A will no longer require a separate waiver application. Instead, all technical justification must be included with the application for an on-site sewage system permit.
This change does not affect the existing waiver application process for other provisions of WAC 246-272A. Specifically, Class A, B, and C waivers as outlined in WAC 246-272A-0420 and the Washington State Department of Health’s Granting On-site Sewage System Waivers document.
